In many family law disputes, Rushmore is approached to review the documentation that has been disclosed in relation to the matter. We are often requested to provide a report as to whether full and frank disclosure has been provided.

Regulation 13.04 of the Family Law Rules 2004 details what is considered full and frank disclosure. Consideration should also be given to Regulation 12.0512.02, and 13.07.

Typically we can be provided with 3,000 to 4,000 documents covering a range of assets, liabilities and other financial resources. Our approach to these types of engagements is to catalog each document and categorise the document into its respective category. We are then able to identify missing, incomplete and unreadable documents and make an assessment as to the disclosure that has been made.

We find that these reports provide significant clarity to the matter and can refocus the parties to those areas where insufficient disclosure has been made.
