In some litigation, you may require a shadow expert witness to assist you reviewing the work of another expert.

A shadow expert, also often known as an expert adviser or a non-testifying expert, is a party-appointed expert engaged to advise one party during a dispute where the appointment is under the premise that the expert is unlikely to provide either written or oral evidence to the Court.

Undertaking the role neither requires the shadow expert to be independent. The shadow expert does not have an overriding duty to the Court – rather the expert’s duty is to the party they are advising.

The work of a shadow expert witness can identify errors, inaccuracies, omissions and problems with methodology.

The shadow expert may also conduct further investigation which is outside the scope of a single joint expert witness.
