Section 6 of the Queensland Acquisition of Land Act 1967 deals with Easements. This can be seen below:

  • Acquiring authority to only take easement (and not the whole of the land) if this is sufficient (s.6(1))
  • Every person whose estate and interest in the land is injuriously affected by the easement shall have a right to claim compensation under this Act. (s.6(5))
  • The amount of compensation may be agreed between the claimant and the acquiring authority (5A), if it isn’t agreed the claim will be subject to the Act and the constructing authority shall be liable accordingly.
