At section 4 of the SA legislation, an interest in relation to land means a legal or equitable estate or interest in the land or …an easement.
Section 16(3) also states that “the land acquired under this section may be an easement , right, power, or privilege that did not previously exist as such in, under, or in connection with, land.”
The Act does not make any other direct reference to the compulsory acquisition of an easement.
