The Land Acquisition and Compensation Act 1986 (Vic) deals with Easements at various places. This can be seen below:

  • An easement is included as an interest in relation to land at section 3
  • When land is severed from other land during a compulsory acquisition, the acquiring authority may give notice of its intention to make and maintain a gate, bridge, easement, road, right-of-way, crossing, passage or other work. (section s43 (2)). This can effect the amount awarded to the person s.43(4).
  • The rights of an authority to deal with land acquired is covered at s. 109(1). Disposal of land may be subject to an easement or other restriction. Refer s. 109(5).
