The WA Land Administration Act 1997 deals with easements at various places. This can be seen below:

  • Easements in class A reserves (s 44)
  • Overlapping between leases or easements and mining tenements (s 90)
  • Minister may grant easements (s 144)
  • Cancellation of easements (s 145)
  • Easements to subsist (s 146)
  • Easements in gross in respect of Crown land (s 147)
  • Easements over conditional tenure land (s 148)
  • Easements in anticipation of acquisition of fee simple (s 149)
  • Cancellation of easements no longer serving any purpose (s 150)
  • Easements over lands designated for public works (s 193)
  • Easements in gross may be made generally in favour of the State etc. (s 195)
  • Creation of public access easements (s 196)
  • Minister may agree to grant easements in lieu of compensation or purchase-money (s 255); and
  • Court may award easements in lieu of compensation (s 256).
